These Terms and Conditions govern your use of our website and services, including but not limited to tuition, coaching, wellness and arts education. By using this website or purchasing services, you agree to comply with these terms. If you disagree with any part of these terms, please refrain from using our site or services.

2. Application of Terms
By accessing our site or engaging in our services, you acknowledge that these Terms and Conditions apply to your use of our website and services. If you do not agree with these terms, please do not use our website.
3. Website Usage and Service Terms
3.1 Content Ownership
All content, including but not limited to text, images, videos, coaching materials, and downloadable resources available on this website, is the property of N-act Coaching and Wellness and is protected by copyright laws. No content may be used, reproduced, or distributed for commercial purposes without explicit written permission from N-act Coaching and Wellness.
3.2 Prohibited Uses
You may not share, distribute, or link to protected content (e.g., members-only resources, videos) without prior authorization. Unauthorized use of our content or services for commercial purposes is strictly prohibited.
3.3 Public Comments
Any comments or materials shared publicly on the website, including testimonials or feedback, must not infringe on the intellectual property rights of others. Users are responsible for ensuring that their contributions do not violate copyright laws. N-act Coaching and Wellness reserves the right to remove any content or comments that are inappropriate or infringe on intellectual property rights.

4. Purchases, Payment, and Refunds
4.1 Payment Methods
We accept the following forms of payment for services:
- Credit/Debit Cards (Visa, MasterCard, American Express)
- PayPal
- Bank Transfers (details will be provided upon request)
Payments must be made in full before services are rendered unless otherwise stated in writing by Nicolle Nyazika or an authorised representative of N-act Coaching and Wellness.
4.2 Delivery of Services
Once payment has been received, you will receive confirmation via email, along with details regarding the next steps to initiate services or receive digital products.
4.3 Right to Cancel
Clients have the right to cancel their purchase of services within 14 days from the date of booking. However, if the services have already been provided in full during this period, cancellation may not be possible, and no refund will be issued.
Cancellations for Personal, Corporate and Franchisee Coaching Sessions: If services have not been rendered, cancellations must be made at least 48 hours in advance for a full refund or rescheduling. Cancellations within 48 hours are entitled to a 50% refund or a rescheduling.
Cancellations for tutoring and arts coaching including but not limited to LAMDA: These terms are clarified on your booking form, including what to do in the event there are dates you/ your child will need to miss within a teaching block for a term.
4.4 Refunds
Eligible refunds will be processed within 14 business days after the cancellation request has been approved.
4.5 Force Majeure Clause
N-act Coaching and Wellness shall not be liable for any delay or failure to provide services due to circumstances beyond our reasonable control, including but not limited to, acts of God, pandemics, epidemics, natural disasters, war, civil unrest, strikes, lockouts, industrial actions, government regulations or restrictions, or any other events that prevent us from fulfilling our obligations ("Force Majeure Event").
In the event of a Force Majeure Event that directly affects N-act Coaching and Wellness’s ability to provide in-person services or carry out its obligations:
We will notify you as soon as reasonably possible of the Force Majeure Event and its expected impact on our ability to deliver the services.
During the Force Majeure Event, we reserve the right to move any affected coaching sessions or wellness services to an online platform (e.g., Zoom, WhatsApp video, or other virtual meeting spaces).
Alternatively, if the Force Majeure Event affects the availability of a specific coach or representative of N-act Coaching and Wellness, we reserve the right to assign another representative from our team to deliver the services in their place, ensuring continuity.
4.6 Rescheduling or Termination of Services
Should the Force Majeure Event be of a temporary nature, services will be rescheduled or moved online until such time as the Force Majeure Event ceases, and normal services can resume.
In the event the Force Majeure Event is expected to be prolonged or indefinite, either party may terminate the affected service agreement by providing written notice to the other, without liability for compensation, except for any services already rendered or expenses incurred up to the date of termination.
Payments for services that are moved online or conducted by an alternate N-act Coaching and Wellness representative will remain valid, and no refunds will be issued due to changes in service format.
4.6 Customer Obligations During Force Majeure
Clients are expected to make reasonable efforts to accommodate online services or alternative service arrangements as outlined above. If a client is unable to participate in online services, they should notify N-act Coaching and Wellness in writing to discuss potential rescheduling or other solutions.
4.7 Limitation of Liability
N-act Coaching and Wellness will not be held liable for any loss, damage, or delay caused by a Force Majeure Event. While we strive to minimize disruption, certain elements may be beyond our control, and N-act Coaching and Wellness will not be responsible for any indirect, incidental, or consequential losses resulting from such events.
5. Complaints and Dispute Resolution
At N-act Coaching and Wellness, we are committed to providing high-quality services. If you have any concerns or are unsatisfied with our services, please contact us directly at info@n-act.org.uk.
We aim to resolve complaints quickly and fairly. If a resolution cannot be reached, we may refer disputes to an Alternative Dispute Resolution (ADR) provider, in line with UK regulations.
6. Privacy and Data Protection
We are committed to protecting your personal information in accordance with the UK Data Protection Act 2018 and the UK General Data Protection Regulation (UK GDPR). We collect, store, and use your data responsibly. 7. Limitation of Liability
N-act Coaching and Wellness, it’s team members, and Nicolle Nyazika shall not be held liable for any direct, indirect, incidental, or consequential damages arising from the use or inability to use the website or our services, including but not limited to emotional distress, financial loss, or interruption of services.
Under UK law, we do not exclude or limit our liability for:
- Death or personal injury caused by our negligence.
- Fraud or fraudulent misrepresentation.
- Any other liability that cannot be excluded or limited by UK law.
Our services are designed to assist in personal, professional and/ or academic growth, but we do not guarantee specific outcomes. Clients must take responsibility for the application of strategies and practices in order to see results.
8. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes relating to these terms and services will be subject to the exclusive jurisdiction of the courts of England and Wales.
9. Changes to Terms and Conditions
N-act Coaching reserves the right to update or modify these terms at any time without prior notice. Changes will be posted on this page, and continued use of the website or services after modifications indicates your acceptance of the revised terms.
